Terms and Conditions of Sale and Exchange or Refund

1. Subject

These General Terms and Conditions of Sale (GTCS) and Exchange or Refund govern the sale of products via the www.virgomove.com website, operated by SAS Ventoux Cycling. They define the rights and obligations of the parties in connection with the sale of bicycle helmets and electric scooters.

2. Products

The products offered for sale are those described on the Virgo Move website. We endeavour to provide an accurate and faithful description of the products. However, errors or omissions may occur. Photographs of products are provided for information only and have no contractual value.

3. Prices

Pricing: Product prices are quoted in euros (€), all taxes included (VAT), excluding delivery charges. Virgo Move reserves the right to modify prices at any time, but products will be invoiced on the basis of the rates in effect at the time the order is validated.

Additional charges: Delivery charges may apply depending on the amount of the order and the delivery method chosen by the customer. These costs are clearly indicated before the order is validated.

4. Order

Ordering process: To place an order, the customer must select the desired products, add them to the shopping basket, and validate the order by following the instructions displayed on the site. The order is finalized when payment is accepted.

Order confirmation: The customer will receive an order confirmation email containing details of the purchase. The sale will be considered final once this email has been sent.

5. Product availability

Our product offers are valid while stocks last. If a product is unavailable after the order has been confirmed, we will inform you of this as soon as possible by email and will offer you either a refund or a replacement product.

6. Payment

Payment methods accepted: Payment for purchases can be made by credit card, PayPal, or any other payment method available on our site.

Payment security : Transactions carried out on our site are secure. We use SSL encryption to guarantee the confidentiality of bank details.

7. Delivery

Delivery time: Delivery times vary according to destination and delivery method chosen. An estimated delivery time is provided when the order is validated.

Delivery address: Products are delivered to the address indicated by the customer at the time of ordering. It is the customer's responsibility to provide accurate information. Virgo Move cannot be held responsible for any delay or non-delivery due to an incorrect address.

Delivery costs: Delivery costs are calculated according to the destination and weight of the package, and are clearly indicated before the order is confirmed.

8. International delivery, VAT and customs charges

VAT: For deliveries outside the European Union, the prices indicated on the site do not include the VAT applicable in the destination country. The customer is responsible for payment of any local VAT or other taxes applied by the tax authorities in the country of receipt.

Customs charges: When delivering to countries outside the European Union, customs charges or import duties may be levied by local authorities. These charges, which vary from country to country, are the sole responsibility of the customer. Virgo Move is not responsible for these additional costs and cannot estimate their amount in advance.

Customer responsibility: It is the customer's responsibility to find out about import duties and taxes applicable in their country. In the event of refusal to pay customs duties or import VAT, and if the package is returned to Virgo Move, the return costs will be deducted from the refund of the order.

9. Right of withdrawal

In accordance with the legal provisions in force, the customer has a period of 14 calendar days from receipt of the product to exercise his/her right of withdrawal without having to justify his/her reasons or pay any penalties. To exercise this right, the customer must notify Virgo Move by email at contact@virgomove.com and return the product in its original condition.

10. Product returns

Products are returned at the customer's expense, except in the case of a defective product or delivery error on our part. Products must be returned in their original condition, with all accessories and original packaging. Refunds will be made within 14 days of receipt of returned products.

11. Warranty

Our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, in accordance with legal provisions. In the event of a product defect, the customer must inform us as soon as possible and return the defective product. We will then repair, replace or reimburse the product, at your discretion.

12. General Conditions of Exchange or Refund

12.1 Conditions of eligibility for return or exchange

Withdrawal period: You have a period of 14 calendar days from the date of receipt of the product to exercise your right of withdrawal and request an exchange or refund.

Product condition: The product must be returned in its original, unused condition, with all accessories, manuals and original packaging. Any product that is damaged, worn or shows signs of use will not be eligible for an exchange or refund.

Proof of purchase: Proof of purchase (invoice or receipt) is required for any exchange or refund.

12.2 Return or exchange process

Request for return or exchange: To initiate a return or exchange, please contact our customer service department at contact@virgomove.com, specifying your order number and the reason for the return or exchange.

Product shipment: Upon approval of your request, we will provide you with a return label or specific instructions for returning the product to our warehouse. Return costs are at the customer's expense, except in the case of a defective product or error on our part.

Processing time: Once we have received the returned product, we will examine it. Processing your exchange or refund request will take approximately 7 to 14 working days. You will be informed by email once your request has been processed.

Customer responsibility: It is the customer's responsibility to find out about import duties and taxes applicable in their country. In the event of refusal to pay customs duties or import VAT, and if the parcel is returned to Virgo Move, the return costs will be deducted from the refund of the order.

12.3 Product exchange

Exchange conditions: If you wish to exchange your product for another model, color or size, please indicate this preference when making your request. The exchange will be carried out subject to availability of the desired product.

Additional costs: If the exchanged product is of a higher value than the original item, the difference in price must be paid before the new product is dispatched. If the exchanged product is of a lower value, the difference will be refunded.

12.4 Refunds

Method of refund : Refunds will be made via the same payment method used for the original purchase, unless otherwise agreed by us.

Refund period: Once your return has been validated, the refund will be made within 7 to 14 working days. A confirmation email will be sent to you.

12.5 Exclusions

Products on promotion or liquidation, except in the case of manufacturing defect or delivery error on our part, are neither exchangeable nor refundable.

12.6 Defective product or delivery error

If you receive a defective product or if the item delivered does not correspond to your order, please contact us immediately at contact@virgomove.com. We will organize the return of the product and offer you a replacement or a full refund.

12.7 Customer responsibility for delivery

If the return is at the customer's expense, the customer is responsible for any damage or loss incurred during transport of the returned product. We recommend that you use a trackable delivery service to ensure that your return is received correctly.

13. Liability

Virgo Move cannot be held responsible for any damage resulting from misuse of the product purchased. Virgo Move's liability shall in any event be limited to the amount of the order.

14. Protection of personal data

The information collected during the ordering process is necessary to process the order. This data is processed in accordance with our privacy policy. Customers have the right to access, rectify and delete their personal data by contacting us at contact@gmail.com.

15. Intellectual property rights

All elements of the Virgo Move website (texts, images, logos, etc.) are the exclusive property of Virgo Move or its partners. Any unauthorized reproduction or use is strictly prohibited.

16. Applicable law and disputes

These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing amicable settlement, the dispute will be referred to the competent courts.

17. Modification of general terms and conditions

Virgo Move reserves the right to modify these terms and conditions at any time. The modifications will be applicable to all orders placed after the date on which the conditions are updated on our website.
